More than 1200 people could receive settlements after hospital data breach

More than 1200 people could receive monetary damages following the tentative settlement of a class-action lawsuit against a Dothan hospital.

The suit came after employee Kamarian Millender stole data from the laboratory, and then used the information to file fraudulent federal income tax returns.

Millender, arrested in 2014, pleaded guilty to stealing the records and served a prison sentence.

Under the agreement, those who suffered would be reimbursed out-of-pocket credit monitoring costs and receive up to four hours in lost wages. They would also be paid interest on delayed tax refunds caused by the data breach.

However, no punitive damages, including those for emotional distress, will be awarded. The cap on damages is $5,000 per person and $150,000 total for all claims. All claims must be filed by December 13.

If a federal judge approves the plan, and he likely will, the agreement would end the four-year old suit against Flowers Hospital.
