Man set free from jail for crime than never happened

(WTVY) — A Coffee County man sentenced to life without parole has been ordered set free and will get a new trial, for a crime that apparently never happened.

Bobby Monaghan was charged with molesting two teenage girls in 2004.

While in jail on those charges, a cellmate, Joseph Boyette, accused Monaghan of sodomy.

Monaghan was convicted on that charge based solely on the testimony of Boyette.

But now Boyette has submitted an affidavit saying he lied and that Monaghan is innocent.

Judge Shannon Clark ordered Monaghan released from prison until a new trial can be held, but a date has not been set.

Ironically, when Monaghan was tried on the original charges of molesting the two girls, he was found not guilty on all counts.
