COFFEE COUNTY, Ala. (WTVY) - Charges have been dismissed against a cold case capital murder suspect, but could be refiled later.

Bobby Hvarven was arrested two years ago for the 2007 shooting deaths of James Matthew Helms and Scott Allen Heib in Coffee County.

District Attorney Tom Anderson says he recommended that charges be dismissed after consulting with the victims' families because investigators are still trying to locate a material witness who hasn't been seen for two years.

Investigators also want to re-interview a man now living in Mobile who was eliminated as a potential suspect more than ten years ago.

Anderson says charges could be filed against Hvarven again at a later date.

Hvarven is currently a free man.
