Federal Judge Allows Ed O'Bannon Lawsuit Against NCAA to Proceed

INDIANAPOLIS (AP) -- The NCAA says a federal judge's decision to allow a lawsuit involving former UCLA basketball star Ed O'Bannon and other former college players to move forward will not change its case.

The statement comes less than 24 hours after U.S. District Judge Claudia Wilken dismissed the NCAA's motion seeking to throw out the lawsuit. The governing body for college sports argued the former players have no legal standing to sue the NCAA.

The players say the NCAA uses images of student-athletes without their permission.

NCAA chief legal officer Donald Remy issued a statement Wednesday saying that, despite losing this round in court, Wilken has shown "skepticism" about making this a class-action lawsuit as the players want.

A hearing is scheduled for May 9. Wilken is based in Oakland, Calif.
