A superior court judge delayed his deposition in a civil case Thursday.
Edwards' mistress, Rielle Hunter, sued Edwards' former campaign aide, Andrew Young, alleging he took the alleged tape.
Young's attorney is disappointed the case can't move forward, but the judge says forcing Edwards to answer questions could jeopardize his rights as a defendant in his federal criminal case.
The former presidential candidate was indicted earlier this month on four counts of violating federal campaign finance laws.
