Congresswoman Gabrielle Giffords remains in intensive care at a Houston rehabilitation center because of a buildup of fluid in her brain. Doctors say her condition is improving daily. Meanwhile in Phoenix...the man accused of shooting her is in court today.
22-year-old Jared Loughner is charged with the attempted assassination of Congresswoman Gabrielle Giffords and the attempted murder of two of her aides.
He's accused of opening fire at a political meet and greet event in Tucson hosted by Giffords that left six people dead and more than a dozen injured.
Federal and state prosecutors plan to eventually add more charges.... including murder...and are expected to seek the death penalty.
But before any juries are slected ....the courts will have to decide if Loughner is mentally competent to stand trial.
Many expect the defense to claim he was insane at the time of the shootings.

Congresswoman Giffords is now at a Houston rebab facility where her doctors say she is improving daily. But fluid on the brain has kept her in the intensive care unit and there is no word on when she will begin the full rehabilitation program.
