New Mexico: The Actual Federal Case Involving a "Kick Me" Sign


It's one of the oldest pranks in the book: putting a sign with the words "Kick Me" on someone's back.

But it didn't just lead to criminal charges it led to convictions, and firings, and a federal lawsuit.

Last year, Rio Rancho Police were investigating the "Kick Me” crime at Intel.

Now two men are out of a job and the victim says this went way beyond a few kicks in the behind.

Harmless Fun or a Criminal Plot?

In high school, a "Kick Me” sign makes for a funny YouTube video.

But as one case at Intel shows: the adult world's a little different.

According to a Federal discrimination lawsuit filed last week, Intel worker Harvey Palacio had a kick me sign stuck to him last year.

He asked co-worker Randy Lehman if there was anything on his back, Lehman then kicked Palacio in the butt.

Palacio asked him to take the sign off, but Lehman kicked him two more times.

So Palacio went over to another coworker Chris Zeltinger, asking them to take the sign off.

Zeltinger kicked him too.

According to Palacio's lawsuit,. Zeltinger told him that "no really turn around and I will remove it." before kicking him again -- and he claims the kicks were hard.

That wasn't the only prank, Palacio claims coworkers had repeatedly hidden his clean room suit and filled his work bag with trash.

Intel may be in trouble too.

Palacio's claiming he was bullied because he's Filipino, and that the company allowed the harassment to go on causing emotional distress.

Lehman's attorney tells me in a statement that his client is very sorry Palacio got hurt.

Zeltinger's attorney didn't return a call for comment.

Both men were given sixteen hours of community service for kicking Palacio.

Palacio and his attorney declined requests for an interview.

Intel says it's still looking over the lawsuit and did not want to comment.
