Court Upholds Voter-Approved Ban on Considering Race in College Admissions

Michigan's voter-approved ban on the use of race as a factor in college admissions is going to stick.

The Supreme Court upheld the ban in a 6-2 ruling. Writing for the majority, Justice Anthony Kennedy says voters chose to eliminate racial preferences, presumably because they could lead to race-based resentment.

But in a lengthy dissent, Justice Sonia Sotomayor says "without checks, democratically approved legislation can oppress minority groups."

A lower court had overturned the ban as discriminatory.
