Benjamin Trial

Testimony resumes Wednesday in the capital murder trial for a Dothan man who told police he did not intend to kill the victim.

Twenty-two-year-old Brandon Benjamin is charged in the November 2000 shooting death and robbery of 52-year-old Jimmy Floyd Lewis of Ozark.

Lewis was gunned down in the parking lot of Wiregrass Commons Mall.

Benjamin was arrested after a search of his home turned up the victim's wallet and a possible murder weapon.

Benjamin told police in a video taped statement that the gun fired accidentally during a struggle with Lewis.

Judge Jerry White ruled yesterday that jurors would be allowed to consider Benjamin’s statement.
