DALEVILLE, Ala. (AP) - A Daleville mother charged with reckless endangerment after her infant tested positive for marijuana still has custody of the child, but DHR officials say current legislation prevents them from taking action.
23-year-old Shelia Channel was arrested on March 6th after the baby she delivered on February 15th at an Enterprise hospital tested positive for marijuana.
Channel was released on a 500 dollar bond the same day.
Dale County District Attorney Kirke Adams said it must be proved that the mother's inhalation was intentional. He said a mother can say she didn't know it was marijuana she was smoking.
Dale County DHR director Sylvia Dodgen said there have been at least four similar cases involving babies in Dale County since January.
