A date has been set for the re-trial of a Dothan man charged with capital murder.
Twenty-six-year-old Leslie Miller is accused in the stabbing death of Alicia Peters of Dothan.
The 18-year-old was attacked during an altercation in a home on Herring Street in April of 2004.
Miller had been involved in an earlier dispute at the same location and was forced to leave but investigators say he came back armed with a knife.
Peters was treated at a Dothan hospital and released and refused to press charges.
Less than two days later, she died from her wounds.
A jury deliberated for two days in September without reaching a verdict in the case.
Miller's re-trial is scheduled to begin February 5.
