A mistrial was declared last Friday for 27-year-old Ruben McNabb.
But when he was returned to jail, a corrections officer misinterpreted the court records and released him.
Houston County Sheriff Lamar Glover said he's especially concerned because he was not informed about the mistake until Wednesday.
Jailers have been in contact with McNabb on his cell phone and he reportedly said he would turn himself in, but so far he's still at large.
