At a news conference Tuesday, Commission Chairman Mark Culver announced the suit against Clark Construction Company for "non-performance of contract obligation."
In November of 2002, the construction company submitted another claim for more money and an additional seven months to complete the project.
County commissioners said nothing has been done to warrant the excessive claim and the taxpayer's shouldn't be asked to pay any additional money.
Culver said the contractor has not been paying subcontractors on time, which has added to the delay in finishing the project.
