A former Alabama State University student has won a battle in his lawsuit against the school. Bernard Byrd accused administrators of advertising courses for his major that were never offered.
Originally, a Montgomery County Circuit Court found that Byrd had not proven that key university administrators had intended to deceive him. But, the Alabama Supreme Court reversed that decision. And, the justices have sent the case back to the lower court for a retrial. The justices said the school's board of trustees and university president should not be defendants.
The Alabama State University campus was closed for the holidays and administrators were unavailable for comment. Attempts to reach Byrd, who withdrew from Alabama State in 2000, were also unsuccessful.
