Recounting Ballots

Two Alabama counties have granted Gov.Don Siegelman's request to recount the votes from last week's gubernatorial election, but now Russell County has run into a setback.

Russell County Probate Judge Albert Howard said he plans to proceed with a recount Thursday in the governor's race. But Sheriff Tommy Boswell said he won't provide the ballots for the recount.

Boswell said he plans to follow the attorney general's opinion that it's a crime to unseal them. He said if he follows the attorney general's opinion, he cannot be prosecuted.

But Howard said he is choosing to follow a secretary of state's interpretation of Alabama's voter laws.

There's no word yet on how the deadlock between the judge and the sheriff will be broken.
