ATLANTA (AP) - A federal appeals court has rejected a bid to overturn the death sentence of Marcus Wellons, who was convicted of raping and strangling a 15-year-old Cobb County girl almost 20 years ago.
Wellons appealed on several grounds, including a claim that a ruling by the trial judge impaired his insanity defense in the death of India Roberts in the summer of 1989. The girl was a neighbor of Wellons' girlfriend, who was in the process of kicking him out of her apartment.
A federal judge denied Wellons' habeas corpus petition, and a three-judge panel of the 11th U.S. Circuit Court of Appeals upheld that ruling Monday.
