Judge rules to move man's retrial out of county

DELAND, Fla. (AP) - A judge ruled that the retrial of an Orlando man accused of killing two Deltona discount store clerks will be moved out of Volusia County.

The retrial was moved by Circuit Judge James R. Clayton on Monday at the request of Roy Lee McDuffie's attorneys.

A spokeswoman says the judge and chief judge make the final decision on the venue.

McDuffie, 45, is being retried in the 2002 deaths of 26-year-old Dawnielle Beauregard and 39-year-old Janice Schneider.

McDuffie was convicted of the murders and sentenced to death in March 2005. The Florida Supreme Court said the trial judge did not
err by denying a motion to acquit, but ruled McDuffie did not get a
fair trial and overturned his murder conviction and death sentence.
