A motion is reportedly filed to drop a lawsuit in the death of a Headland man.

A local law firm filed the case against the city of headland in the death of 33-year-old O’Patrick Fitzgerald Humphrey.

Humphrey was fatally shot by police on January 31st.

Authorities say an officer fired his gun and struck Humphrey after he attacked paramedics and ignored repeated warnings.

The motion details events that took place on the morning the headland officer was required to use deadly force.

The defendants have been given until June 5th to respond to the motion to dismiss.
