Sheriff LeRoy Upshaw and Investigator Lt. David Morris arrested a Montgomery, Alabama couple on August 22, 2011 for Burglary 3rd Degree and Theft Of Property 3rd Degree.
The couple was arrested inside Walmart on S. Eufaula Ave. Eufaula, Alabama. Lt. Morris received information on August 20, 2011 that the couple was selling items to a business in Eufaula by the business owner.
The caller had concerns when the items being sold or attempting to be sold appeared to be new and that a couple of the items had Walmart price tags.
Sheriff Upshaw advised Lt. Morris to immediately start an investigation into the concerns of the caller. Lt. Morris gathered the information of the suspects and took the items in question into the Sheriff's Office possession. Lt. Morris requested the Sheriff's assistance in an attempt to apprehend the suspects on August 22, 2011. The couple was located inside Walmart and taken into custody.
Richard Devin Fulton, 26 and Deborah Lynn Fulton, 42 of Montgomery, AL. were both charged with one county of Burglary and Theft.
Through further investigation, Lt. Morris charged both suspects with four additional counts of Burglary 3rd Degree and Theft Of Property 3rd Degree on September 13, 2011. With bonds Totaling $85,000.00 each.
Lt. Morris said that the couple has been in Eufaula for approximately three months, living in motels while committing the crimes.
Sheriff Upshaw said that through the investigation, it has been determined that other business in Eufaula have been burglarized and items stolen by the couple and that evidence is attempting to be collected by Lt. Morris for additional charges to be brought against the couple.
