ORLANDO, Fla. (AP) -- A judge in Orlando has denied a motion by The Associated Press and the Orlando Sentinel to release a probable cause affidavit used for the arrests of the 13 defendants charged with the hazing death of a Florida A & M University drum major.
Circuit Judge Marc Lubet said Friday that neither media organization had the authority to intervene in the case. The judge, though, left open the door for another challenge by recommending that the media groups seek an order requiring a government agency to carry out a task its duty.
The State Attorney's Office in Orlando has refused to publicly release the probable cause affidavit, saying it's exempt from being released because it's part of a criminal probe.
