COLUMBIANA, Ala. (AP) -- A Shelby County Circuit Court jury has
found a Kimberly pharmacist guilty of capital murder in the Dec. 3,
2009 shooting death of a Pelham police officer during a late-night
traffic stop on Interstate 65.
The jury deliberated for about two hours Thursday before finding Bart Wayne Johnson guilty in the fatal shooting of Officer Philip Davis. The sentencing phase of the trial was beginning Thursday afternoon. Jurors will decide whether to recommend that Johnson be sentenced to life in prison without parole or given the death penalty. The judge is not required to follow the jury's recommendation.
Defense attorneys said that Johnson was mentally disturbed.
Authorities said Davis was shot as he walked back to Johnson's car after writing him a ticket.
