An accused murderer's statement will make it into court in Holmes County, FL.

A judge denied Johnny Mack Calhoun's request to have his statement thrown out.

His attorneys filed the motion because there were questions regarding their client's right to remain silent.

Calhoun is accused of murdering 24-year-old Mia Chay Brown in 2010.

The judge backed his decision, saying there was no violation of Calhoun's constitutional rights.
