Former Lockhart Police Chief Guilty of Misusing Position

(MONTGOMERY)--Attorney General Luther Strange and ACJIC Director Maury Mitchell, a member of the Attorney General's Special Prosecution Alliance, announced the felony ethics conviction of former Lockhart Police Chief John D. Davis II. Davis, 37, pleaded guilty on October 16 in Covington County Circuit Court to one count of using his official position for personal gain, related to his unauthorized use of the Law Enforcement Tactical System ("LETS") in exchange for money.

"This case is a sad example of someone who has betrayed the trust of the citizens and the law that he was sworn to uphold, and abused his power by misusing confidential information for profit," said Attorney General Strange. "Our message to all is that public corruption must be fought so that Alabama citizens may have confidence in those who serve the public."

The Attorney General's Office partnered with the Alabama Criminal Justice Information Center in investigating this case. The State's evidence against Davis included documents showing that he misused the access he had to LETS as a police officer to obtain the criminal records of numerous individuals. The evidence also shows that Davis received multiple payments in exchange for accessing criminal records via LETS.

Under a plea agreement, Davis pleaded guilty to one count of using his official position for personal gain, a Class B Felony, and was sentenced to eight years imprisonment, which was suspended for a period of five years of probation. Davis also agreed to pay court costs, $100 to the Victims Compensation Fund, as well as a $5,000 fine.

The Attorney General commended Assistant Attorney General Pete Smyczek of the Attorney General's Special Prosecutions Division, as well as special agents from the Alabama Criminal Justice Information Center, for their successful handling of this case.
