(Dothan, AL)—A federal judge has ruled that the Headland Police Officers are justified for fatally shooting a 33-year-old man.
Police shot and killed O’Patrick Humphrey back in January. His mother called 911 after saying he was schizophrenic and had not taken his medication. Police reportedly arrived on the scene after Humphrey tried to attack paramedics.
The first police officer, Tony Franks, shot Humphrey in the arm after he was attacked. Franks was unconscious when the second officer, Tony Smith, arrived. Smith then fatally shot Humphrey in the groin.
The judge said the ruling in this case was based upon the plaintiff’s inability to prove that police violated Humphrey’s constitutional rights. Humphrey’s family has until July 16th to amend a complaint in this case.
