MONTGOMERY, Ala. (AP) - A jury has found a Montgomery man guilty of capital murder in the 2008 killing of his own 3-year-old son.
The Montgomery Advertiser reports that after the verdict was handed down Thursday Judge Tracy McCooey sentenced 38-year-old Alvin Johnson to life in prison without possibility of parole.
Defense attorneys had said that Johnson killed his son C.J. accidentally on May 1, 2008, but prosecutors said he knew what he was doing. The boy died from an internal head injury.
Prosecutors relied heavily on medical evidence and the testimony of another inmate charged with capital murder. Joshua Ward, 29, testified that Johnson told him he killed his son in a rage and then drove him to the hospital so he'd look like a caring father.
Deputy district attorney Kevin Donaldson says the family is happy about the verdict.
