BIRMINGHAM, Ala. (AP) - Birmingham police have charged a man
with capital murder after they say he fatally struck his
girlfriend's 3-year-old son in the chest.
Sgt. Scott Thurmond tells The Birmingham News that 36-year-old
Marcus Smith was questioned Tuesday morning and then charged in the slaying of Israel Owens.
Thurmond says Smith was at work at the UAB Health Information Management Department at UAB Hospital between 1:40 a.m. and 2:36 a.m. Sunday when he hit the boy.
Smith took Israel to work with him because the boy's mother was also working.
Thurmond says the blow caused a tear in the boy's heart, and he
died within a few minutes.
An autopsy also showed signs of prior abuse.
Smith was being held Tuesday without bond.
