Judge Considers Suit to Keep Obama off Alabama Ballot

BIRMINGHAM, Ala. (AP) -- A state judge is considering a lawsuit aimed at keeping President Barack Obama off the ballot in Alabama
this year.

Circuit Judge Helen Shores Lee has scheduled a hearing for Monday in Birmingham on a complaint that argues Obama isn't a natural-born U.S. citizen so he can't legally serve as president. The man who filed the suit, Albert Hendershot Jr., says Obama has a fake birth certificate and Social Security number. He sued state Democrats trying to keep Obama off the ballot in the presidential election.

The Democratic Party says the claims are political fantasy. Despite multiple lawsuits, the so-called birther movement hasn't persuaded a court that Obama's birth certificate is fake.

Hendershot says he will appeal to the Republican-dominated Alabama Supreme Court if he loses in circuit court.
