BAY MINETTE, Ala. (AP) -- A judge has ruled that a former Mobile County Commissioner will be retried on his murder charge in Houston County.
Stephen Nodine faces charges of murder and aggravated stalking in connection with the Mother's Day 2010 shooting of Angel Downs, a Gulf Shores real estate professional with whom he was involved in a long-term affair.
Baldwin County Circuit Judge Charles Partin scheduled Nodine's trial for Sept. 10 in Dothan.
His first murder trial took about two weeks before ending in a mistrial after a jury was unable to agree on a verdict.
Nodine has maintained that Downs shot herself.
The ex-commissioner was considered a rising GOP star with ambitions for higher office before he pleaded guilty to a drug possession charge.
