MONTGOMERY, Ala. (AP) - A judge in Birmingham has scheduled a
hearing on a request by former Birmingham City Councilman Jimmy Blake to remove Republican Robert Bentley from Tuesday's ballot for
governor.

Blake contends Bentley has violated campaign finance laws and his name shouldn't be on the ballot. Circuit Judge Nicole Still will hear arguments Friday morning on Blake's request for a preliminary injunction removing Bentley's name.

Bentley says the lawsuit is without merit, and it is designed to confuse voters and suppress turnout.

Bentley faces Democrat Ron Sparks in Tuesday's election.
