The Alabama Department of Education and two school districts are being sued.
State Sen. Bryan Taylor, R-Prattville, filed the lawsuit on behalf of a parent.
At issue is a 2010 law forbidding payroll deductions for groups involved in political activity.
The law was challenged in court. The suit says during that process Hoover City and Shelby County schools continued payroll deductions.
A memo sent out last month by the state board of education made it clear an appeals court upheld the law and deductions must stop as a result.
The lawsuit says the state board and two school systems are moving too slowly in complying with the law.
The Alabama Education Association has appealed the court's decision.
