UPDATE: Monday, July 19, 2010, 12:00 p.m.

There are new details regarding the murder of 4-year old Curtis Alexander Ruede.

Police say 25-year old John Curtis Davis has confessed to shooting his nephew. Davis will be charged with capital murder, and is being held without bond.

Police say if found guilty the minimum sentence he would serve is life in prison without parole. The maximum sentence would be the death penalty.

Police say that the child was shot with a .177 caliber pellet riffle.

Davis will be appointed an attorney within the next 48 hours.

Preliminary hearings could begin sometime in the next few weeks.

The suspect has since been arrested; however, the suspect is the victim's uncle.

On Friday afternoon, authorities say, 25-year old John Curtis Davis shot and killed his 4-year old nephew Curtis Alexander Ruede.

Family members say, Davis was upset after a toy dropped on his foot.

Ruede was transported by Opp EMS Ambulance to Mizell Memorial Hospital.

Officials say, he was pronounced dead hours later.

Davis is facing Capital Murder Charges.

The case is still under investigation by the Alabama Bureau of Investigations.

    what is so sad nothing gets done to the people who hurt the kids i think if they start gettin punished like they should it might save some lives of other kids but they never do anything it breaks my heart to see a kid like this if they didnt want him there r plenty of people that cant have babies would love to have one

    John Curtis Davis is 25...he is also slightly mentaly retarted and that is no excuse for what he did I am their uncle... little Curtis was my great nephew..and John Curtis is my nephew I and the rest of the family agree what he did was beyond excuse....and we wonder how...how can an angry man grab and load a pellet gun and shoot a child with other adults around and them not stop him?

    Either this man is completely nut's or this was a way of covering up something more terrible. No one in their right mind would just shoot a child for something this silly.God bless the family. I am so very sorry for your loss, but he's in HEAVEN now and no one can ever hurt him again.

    this guy should get the death penalty. it was a child for hevens sake. you do not shoot a child for dropping a toy on your foot that maybe weighs a couple of pounds. heck you don't shoot anyone for that matter. to the family you are in my prayers. GOD Bless.
