AL Supreme Court Strikes Down Illegal Order from Greene County Judge

MONTGOMERY, AL – The Alabama Supreme Court late today struck down an illegal order issued Tuesday night by a Greene County judge that required the Governor’s Task Force on Illegal Gambling to leave Greenetrack casino property.

The State had appealed Circuit Court Judge Eddie Hardaway’s order issued last night at 11:47 p.m.

In very strong terms, the Supreme Court said Judge Hardaway “had no authority to enjoin or interfere with the law enforcement operations” of the Task Force at Greenetrack. “Compliance with an order of this Court is not optional. The 11:47 p.m. order makes it necessary for this Court to act immediately to protect the authority of this Court and the integrity of our prior order.”

That prior order was one issued on Monday by the Supreme Court saying the Task Force could carry out law enforcement operations at Greenetrack.

In its ruling late Wednesday, the Supreme Court ordered that the Task Force can reenter the Greenetrack casino.

“The rule of law has prevailed,” said Task Force Commander John Tyson, Jr.
