Judge won't rule on bingo machines for Etowah Co.

GADSDEN, Ala. (AP) - An Etowah County judge has rejected a lawsuit that sought to determine the legality of electronic bingo machines planned for a gambling hall in the north Alabama county.

Circuit Judge Allen Millican ruled Wednesday that it is improper for him to rule on a suit brought by District Attorney Jimmie Harp. The judge based his decision on a ruling from the Alabama Supreme Court on Friday that said declaratory judgment actions like this one are not proper in the courts.

Gov. Bob Riley called the ruling another victory for opponents of electronic bingo.

CBS Supply has been planning a $200 million electronic bingo development in Etowah County.
