MONTGOMERY, Ala. (AP) - The Alabama Supreme Court has set an
execution date of Oct. 8 for death row inmate Max Landon Payne of
The court announced the execution date Tuesday.
Payne was convicted of kidnapping, robbing and killing the owner
of a Cullman grocery store, Braxton Brown, in 1992. Attorney
General Troy King asked the Supreme Court to set an execution date
because Payne had finished his appeals. The U.S. Supreme Court
turned down his case in May.
Brown, the victim, was kidnapped from West Point Grocery during
a robbery on March 23, 1992. His body was found the following day
in Crooked Creek. He had been shot in the head. Payne was arrested
one day later at the bus station in Miami, Fla.
