Sex charges dropped after mom won't return to Alabama

FLORENCE, Ala. (AP) - Charges against a man accused of having sex with a 5-year-old girl have been dismissed after the child's mother said neither she nor the child would return to Alabama to take part in the prosecution of the case.

Lauderdale County District Attorney Chris Connolly said a motion to drop the charges against 28-year-old James Lee Smith of Florence was filed last week.

Smith, who was accused of having sex with the girl while she was visiting his home, was charged with rape, sexual abuse and sodomy in September. The incidents allegedly took place between October 2007 and March 2008.

The TimesDaily reported Thursday that Smith remains in prison for failing to report as a sex offender from Illinois when he moved to Alabama. It was not disclosed where the mother and child now live.
