The Alabama Supreme Court has ruled in favor of the city of Dothan.
It's concerning a lawsuit where 60-year-old Larry Downing was struck and killed by Tabitha Farmer who had been stopped and released by police a short time earlier for eratic driving.
Police testified that Farmer was released because she passed a field sobriety test.
Farmer later plead guilty to murder and admitted she was high at the time of the crash.
Downing's widow filed a wrongful death lawsuit against the city contending that farmer should have been arrested before her husband was killed.
The supreme court upheld a lower court ruling that Dothan Police did not exceed their authority when they released Farmer.
