Lawyers Involved in the Dothan Landfill Expansion

The decision to expand the Dothan landfill will continue into the New Year.
Now attorneys are involved in the decision to move forward.

According to Dothan city commissioners, the city landfill is overflowing and it's time to expand.
But the proposal has been met with a lot of controversy, this time it's opposition over the decision of the zoning adjustment board.

"The staff has read some court decisions that in Alabama that says that for a public purpose or public project that the city zoning laws don't apply in that, municipality," says City Manager Mike West.

So now the commission wants City Attorney Lenton White to request the state Attorney General's opinion on if the city is within its right to allow the zoning board to apply zoning regulations for the expansion.

Even though the vote passed by a 4-2 margin, those who voted "no" think the commission should stick to the zoning board's lack of attention to the matter.

"They have voted, then why should I come back and supersede what the person I have put on the board, they have already voted," says District 1 City Commissioner James Reading.

"We are asking the attorney general to make a decision on how the board of zoning handles non municipal property," says District 2 City Commissioner Amos Newsome.

It's an issue that has been in the works for months now, and once the matter reaches the desk of the attorney general the issue will continue well into the New Year.

"We're hoping the fairly quickly, but we will have over that, you know we are hoping a couple of weeks it could take thirty days,” says City Manager Mike West.

Days that will keep the people of Dothan from knowing if and when a 14 dollar and seventy five cent fee will start for trash pick up.

Once the attorney general gives his opinion on the zoning matter, commissioners can decide on how to move forward with expanding the landfill.
