MONTGOMERY, Ala. (AP) -- An attorney for a man charged with capital murder in the shooting deaths of three men at an apartment complex near Auburn University said she plans to seek testimony from a man who was with her client the night of the shooting.
Montgomery attorney Susan James filed a motion Friday asking that Jeremy Thomas be brought to the Lee County Criminal Justice Center in Opelika to testify at a 3 p.m. Wednesday hearing for defendant Desmonte Leonard.
Leonard is charged with three counts of capital murder and two counts of assault in the June 9 shootings. Lee County District Judge Russell Bush will decide if there is sufficient evidence for a grand jury to consider charges against Leonard.
