Reporter in Colorado Theater Shootings Fights Order to Testify

DENVER (AP) -- A Fox News reporter in New York is appealing a judge's order to appear in a Colorado court to identify her sources for a story about a notebook that movie theater shooting suspect James Holmes sent a psychiatrist before the killings.

Reporter Jana Winter's attorney says appeal documents are being filed Monday. The attorney says Winter will also seek a stay blocking the judge's order that she testify in Colorado on April 1.

Winter reported that before the July 20 assault that killed 12 people and injured 70, Holmes sent a psychiatrist a notebook containing drawings that foreshadowed the attack. The story quoted unidentified law enforcement officials.

Holmes' lawyers say the leak violated a gag order in the case. They want Winter's sources to be identified and punished.
