Ozark Shooting Investigation

UPDATED: Police responded to a call regarding a man with a weapon in Ozark.

Police were called to the 200 block of East College Street around 11:33 a.m. on Monday morning. Officer said the suspect had a gun and he refused to put it down.

The officer took cover and asked him to put the gun down. When he refused the second time, police were forced to use deadly force.

Neighbors said they knew the man as Mr. Earl. They said he seemed to suffer from severe depression due to losing his wife more than ten years ago.

One neighboring family said they were walking down Deer Avenue this morning when the man came out and told them to get off of his property.

When they responded saying they were on a public street, the neighbors said he pulled a gun. This is when one male neighbor said he called the Ozark police. He said the rest is a blur.

"It was so fast. Bullets were flying everywhere and I was standing in the middle of the road," one neighbor said. "I'd do it now and I'd do it again. These are my kids."

The officer took cover and asked him to lay down the gun again but he refused and the officer shot him.

The Alabama Bureau of Investigation Agents are working this investigation.
