Judge Weighs Restitution in Inmate Beating Death

MONTGOMERY, Ala. (AP) -- A federal judge will decide next year whether the family of a fatally beaten inmate will receive restitution in addition to the $900,000 settlement the family received from the state prison system.

U.S. District Judge Myron Thompson held a short restitution hearing Friday for three former prison employees sentenced to federal prison for their roles in the death of inmate Rocrast Mack at a state prison in Clayton in 2010.

Prosecution and defense attorneys argued about which family members could recover and what their expenses were for Mack's burial, attendance at court hearings, and other items associated with the case.

Thompson gave attorneys until Jan. 3 to file written arguments. He indicated any restitution would be small compared to the $900,000 settlement Mack's family got from the state.
