The family of Kendrick Johnson is suing the Lowndes County Georgia school system over his death.
The suit alleges the district was negligent in protecting their son from harassment and bullying.
The family contends that's what led to Johnson’s death.
His body was discovered in a rolled-up mat in the Lowndes County High School gym in January of last year.
Investigators ruled the death accidental.
They say Johnson climbed into the center of the mat, and got stuck.
An independent pathologist however found an unexplained apparent non-accidental blunt force trauma
to Johnson's neck and said his death was a homicide.
