BIRMINGHAM, Ala. (AP) -- A defense lawyer says an Alabama federal judge charged with domestic violence in Atlanta is embarrassed and entering a treatment program.
Barry Ragsdale is representing U.S. District Judge Mark Fuller of Montgomery in an administrative complaint filed by the chief judge of the 11th U.S. Circuit Court of Appeals.
The 11th Circuit has stripped Fuller of his cases, and Ragsdale says the judge isn't in Montgomery.
Ragsdale says Fuller is embarrassed over his arrest and already has received counseling.
Ragsdale says the judge will enter a treatment program within days. He declined to elaborate on the type of treatment Fuller is seeking.
Atlanta police arrested Fuller 10 days ago after his wife called authorities from a hotel saying he was beating her.
A hearing set for Friday is being delayed.
