Ala. AG Seeks Judge's Recusal in Educator's Case

MONTGOMERY, Ala. (AP) -- Attorney General Luther Strange is asking a Montgomery judge to step aside from the criminal case of a former state education official.

Strange filed court papers in Montgomery saying Circuit Judge Johnny Hardwick should recuse himself because the attorney general is prosecuting the judge's son, Khalfani Ahmed Hardwick, on an attempted murder charge and because the judge appears biased against the attorney general's office.

Hardwick is handling the case of Deann Stone and her husband, Dave Stone. She used to be director of federal programs for the state Department of Education. The attorney general's office is prosecuting the two on ethics charges over handling of federal stimulus funds.

Hardwick has not yet ruled on the request to step aside.
