A Houston County jury has recommended the death penalty for a convicted killer. Defense attorneys argued that 23-year-old Brandyn Benjamin was abused and neglected as a child and should be sentenced to life in prison without parole.
However, District Attorney Doug Valeska told jurors Benjamin chose to take a life and deserved to pay the ultimate price for the crime.
Benjamin was convicted of the November 2000 shooting death and robbery of 52-year-old Jimmy Floyd Lewis.
The jury deliberated about 45-minutes before recommending the death sentence. Judge Jerry White will make the final decision.
Sentencing is set for Sept. 2.
