News 4 has learned that David Barber the head of Governor Bob Riley's task force on illegal gambling filed a motion to dissolve the temporary restraining order at country crossing. We are now told barber filed an emergency stop request with the state supreme court.

This means that if the Supreme Court decides to stop the temporary restraining order, Barber and the task force can go into country crossing and perform their raid.

Both Country Crossing spokesman Jay Walker and Governor Riley's press secretary had a lot to say today about this issue.

"The other night, when people heard about the raid, they were wondering if they were going to have a job the next day. They were crying, there were people hurt, and while he was out there enjoying lobster dinner in Pasadena, California, we are down here trying to create jobs, and people were wondering how they were going to pay their bills" said Jay Walker, the Country Crossing Spokesman.

"Casinos actually cause economic damage to communities. They take away far more than they give in jobs and economic development. In plain speak; money spent at the casino is not being spent on milk, or bread, or at the grocery store. Casinos cannibalize local businesses. They siphon money out of the economy" said Gov. Bob Riley’s Press Secretary Todd Stacey.

Governor Bob Riley's task force on illegal gaming is fighting to perform an investigation on Houston County's Country Crossing.

That raid would involve a visit by several state agencies, law enforcement and 18 wheeler trucks to haul away some 1800 bingo machines from a multimillion dollar entertainment complex.

Country Crossing supporters are left wondering why Governor Riley, David Barber, and the task force don't visit first and then act.

"They have never walked on Victory Land or an Indian casino unless Gov. Riley was going to talk about how beautiful their facility is which he did back in November and to my understanding, he has never been anywhere else. We have invited him, we have begged him to come and see what we are doing and they have never done it" said Walker.

“There is no target on anyone, there is no place that is being pointed out or singled out, this is a state wide operation. Slot machines are illegal in every county in Alabama no matter what they are called and you cannot play an illegal game on an illegal device. There are facts. This is just the way it is and Governor Riley is not going to allow anyone to break the law no matter how powerful they think they may be or how politically connected they are" said Stacey.

But country crossing executives say they are legal and governor riley and his task force will be proven wrong.

"I do not think he will prevail. Our attorneys do not think he will prevail. This isn't a dictatorship. This is a Democracy. We're offered due process by the constitution of the United States and we are going to use it to the best of our ability” said Stacey.

Stacey says more than 70 casinos have been shut down in the state of Alabama since the task force was formed and barber was appointed the leader.

A hearing on the restraining order was originally set for January 20th.

Judge Ben Mclauchlin has now scheduled a public hearing on barber's motion to dissolve the order for next Tuesday at the Houston County Courthouse.

But that could change depending on the Supreme Court’s decision.
