ATLANTA (AP) - An appeals court judge says he'll make a decision by Monday in the case of a Georgia man who was sentenced to ten years in prison for having consensual oral sex with a 15-year-old when he was two years older than she was.
In a hearing today, a lawyer for Genarlow Wilson asked the judge to throw out the aggravated child molestation sentence against his client, saying it's grossly unfair.
The defense attorney noted that state lawmakers were trying to target sex offenders who preyed on children -- and that they have since passed a law to close a loophole that led to Wilson's sentence.
However, a prosecutor argued the new law can't be applied retroactively.
In 2003, Wilson was a 17-year-old honors student and athlete who was eyeing college. Someone videotaped the younger girl performing oral sex on him at a party.
