A federal judge has overturned a 1979 death sentence. Fifty-three-year old Billy Joe Magwood has been on Alabama's death row for over 25-years.
He's been convicted of murder for shooting Coffee County Sheriff Neil Grantham.
The murder happened outside the Coffee County Jail, which used to be located in Elba.
District Judge Myron Thompson sustained the murder conviction however, he then ordered Magwood be sent back to Coffee County for a new sentencing phase.
The judge says the death sentence must be thrown out because of the ineffectiveness in the initial 1981 trial.
Alabama Attorney General Troy King plans to appeal the ruling.
