A hearing that could prevent some Dothan police officers from testifying against Police Chief John White has been delayed.
Attorneys for Captain Nick Monday, Sergeant Eddie Henderson, Corporal Carl Midkiff and Administrative Assistant Sheila Luker asked Judge Larry Anderson to block their interrogation.
The personnel board is investigating whether Chief White forced former Captain Jim Smith to re-sign and whether he copied pagers and monitored the telephone calls of city officials.
The personnel board's attorney, Jerry Segrest has asked Judge Anderson to step aside in the case and let another judge handle it.
Judge Anderson is a former city attorney who once worked with a lawyer for one of the police officers.
Also, while serving as president of a Dothan civic club, Judge Anderson was a member of the Citizens Supervisory Committee several years ago and that committee is the one that has requested the investigation of Chief White.
Attorneys for the police officers have no problem with Judge Anderson. Judge Anderson says he'll try to rule on the motion to refuse himself by Thursday.
