County Commission Appointments

A proposed law that originated in Houston County would have statewide impact and reduce the power of the governor's office.

A local law was passed in 1986 allowing special elections to fill vacancies on the Houston County Commission.

But, the Alabama Supreme Court recently ruled a similar law in Mobile County unconstitutional because state law gives the governor the authority to appoint someone to fill out un-finished terms.

Now, a bill sponsored by Senator Jimmy Holley of Elba would "allow" local laws calling for special elections to take precedence over the state law that authorizes appointments by the governor.

The measure has cleared the Senate and is awaiting action in the House of Representatives.
